Personnel outsourcing in Poland has long been a popular and everyday business for successful companies. This allows you to reduce costs, attract situationally better specialists and optimize work. Definition
Personnel outstaffing or agency work is the provision of employees by an employment agency to the customer company. With this form of labor relations, the employee is listed on the staff of the employment agency, but actually works for the benefit and under the direction of the customer company.
Outsourcing is full or partial transfer of non-core processes or functions of one company to another. In this case, the parties enter into a contract (usually longer than a year) for the performance of works or the provision of services.
Both outsourcing and outstaffing can be used in almost any field of activity, if the company needs to complete tasks quickly and efficiently, but its own resources are not enough. However, there are significant differences between these two types of activity.
Subject of the contract
The main difference between these two phenomena is the subject of the contract. When outsourcing, this is one or another service in the necessary volume. In this case, it is not important who exactly will provide the service, how many performers there will be, the specific time of execution is also not important - the main thing is that the terms of the contract are adhered. The contractor must not follow the customer's work order; the customer is not obliged to provide him with a workplace or tools.
During outstaffing, the company orders an employee from an employment agency with certain characteristics: work experience, skills, qualifications. This employee will have to follow the customer's work schedule and work under his control.
Despite the fact that, formally, the employee remains permanently employed by the recruitment agency, there must be a record of work for the customer company in his employment book. In addition, his working conditions and salary should not be worse than those of full-time employees.

In the case of personnel outstaffing , a contract on the provision of personnel is concluded between the employment agency and the customer, as well as an additional agreement is concluded to the employee's employment contract, which indicates the number of such contract and the name/full name of the customer, information about documents certifying the identity of the customer - a natural person, which identifies the party's taxpayer number (with the exception of the receiving party — a natural person who is not an individual entrepreneur), as well as information about the place and date of conclusion, number and term of the contract on the employment of employees. The employment agency remains the employee's employer, labor relations with the customer company do not arise.
Control and management
Another important criterion for distinguishing outsourcing from outstaffing is the one under whose control the executor works. In outstaffing, the customer takes control and management. The performer works from his territory, is subject to his work schedule. The employment agency, as the de facto employer, must pay all necessary contributions and taxes for the employee, as well as replace the employee if he goes on vacation or takes sick leave.
When personnel outsourcing , the employees are controlled by the company providing the service, not the customer. If the executor concludes a civil law contract with the outsourcer, rather than an employment contract, neither the customer nor the outsourcer is obliged to provide him with a workplace or provide the necessary tools; vacations and sick days are not provided.
